1. כללי
1.1. אתר The House of Symbols בכתובת https://houseofsymbols.co (להלן: "האתר") מופעל על ידי זוהר גור אריה, עוסקת מורשית מס' 207021817 (להלן: "העסק", "אנחנו").
1.2. תקנון זה חל על כל שימוש באתר ועל כל רכישה בו. ביצוע הזמנה מהווה הסכמה לתנאי התקנון.
1.3. התקנון מנוסח בלשון אחת מטעמי נוחות בלבד ומתייחס לכל המגדרים.
1.4. העסק רשאי לעדכן את התקנון מעת לעת. על כל הזמנה יחול הנוסח שפורסם באתר במועד ביצועה.
1.5. רכישה באתר מותרת לבני 18 ומעלה, בעלי כתובת דוא"ל פעילה ואמצעי תשלום תקף.

3. המוצרים
3.1. באתר נמכרים תכשיטים משומשים, יד שנייה ווינטג'. אם יוצעו בעתיד פריטים חדשים, הם יסומנו ככאלה בדף המוצר.
3.2. מצב כל פריט, לרבות סימני שימוש, שריטות, פגמים או תיקונים, מתואר בדף המוצר ומתועד בתמונות. התמונות הן חלק מתיאור המוצר.
3.3. רוב הפריטים ייחודיים וקיימים ביחידה אחת בלבד. אין התחייבות להשלמת מלאי או לאספקת פריט זהה.
3.4. ייתכנו הבדלים קלים בגוון ובברק בין התמונה לפריט, בשל תאורה והגדרות מסך. המידות בדף המוצר משוערות, בסטייה של עד ±2 מ"מ.
3.5. תיאור המתכת מבוסס על ההטבעה שעל הפריט (למשל 925). אבנים ושיבוצים לא נבדקו מעבדתית, אלא אם צוין אחרת בדף המוצר. העסק אינו מספק תעודת שמאות או תעודה גמולוגית.
3.6. תליונים נמכרים ללא שרשרת, אלא אם צוין אחרת בדף המוצר. שרשראות ואביזרים המופיעים בתמונות אינם כלולים.
3.7. הפריטים אינם משויכים למותג מסחרי כלשהו ואינם נמכרים כפריטי מותג.
4. מחירים ותשלום
4.1. המחירים באתר נקובים בשקלים חדשים וכוללים מע"מ כדין.
4.2. הצגת מחיר במטבע אחר היא המרה משוערת לנוחות בלבד. שער ההמרה ועמלות ההמרה נקבעים על ידי חברת האשראי או ספק התשלום.
4.3. בהזמנות לייצוא מחוץ לישראל ייתכן שהמחיר יוצג ללא מע"מ ישראלי, בהתאם לדין. במקרה כזה הדבר יוצג בעמוד התשלום.
4.4. דמי משלוח, ככל שחלים, מוצגים בנפרד לפני אישור ההזמנה.
4.5. התשלום מתבצע באמצעי התשלום המוצגים בעמוד התשלום, דרך ספקי סליקה מאובטחים. העסק אינו שומר פרטי כרטיס אשראי.
4.6. העסק רשאי לעדכן מחירים בכל עת. המחיר המחייב הוא המחיר שהוצג במועד ביצוע ההזמנה.
4.7. נפלה טעות סופר בולטת במחיר או בתיאור, רשאי העסק לבטל את ההזמנה ולהשיב ללקוח את מלוא הסכום ששולם.
5. הזמנה ואישור
5.1. לאחר ביצוע ההזמנה תישלח הודעת דוא"ל המאשרת את קליטתה.
5.2. העסקה מאושרת בכפוף לאישור חברת האשראי או ספק התשלום ולזמינות הפריט.
5.3. לא אושרה העסקה, או שהתברר שהפריט אינו זמין, נודיע על כך תוך 3 ימי עסקים וההזמנה תבוטל ללא חיוב. אם כבר חויבת, יוחזר מלוא הסכום.
5.4. מסמך פרטי העסקה, הכולל גילוי בדבר זכות הביטול, יישלח בדוא"ל או יצורף למשלוח.
6. אספקה ומשלוחים
6.1. בישראל: אספקה תוך עד 14 ימי עסקים ממועד אישור ההזמנה.
6.2. לחו"ל: אספקה תוך עד 25 ימי עסקים ממועד אישור ההזמנה.
6.3. ימי עסקים הם א'–ה', למעט ערבי חג, חגים וימי שבתון בישראל.
6.4. במשלוחים לחו"ל, מכס, מיסי יבוא, מע"מ מקומי ועמלות שחרור במדינת היעד חלים על הלקוח, אלא אם צוין אחרת בעמוד התשלום.
6.5. באחריות הלקוח למסור כתובת מלאה ומדויקת. משלוח שהוחזר אלינו בשל כתובת שגויה או אי-איסוף יישלח מחדש בכפוף לתשלום דמי משלוח נוספים, ככל שהדין מתיר.
6.6. הסיכון בפריט עובר ללקוח עם מסירתו ללקוח או לאדם שהלקוח הורה עליו.
6.7. פרטים נוספים מופיעים במדיניות המשלוחים.
7. ביטול עסקה, החזרות והחזרים (לקוחות בישראל)
סעיף זה נערך בהתאם לחוק הגנת הצרכן, התשמ"א-1981, ולתקנות הגנת הצרכן (ביטול עסקה), התשע"א-2010. אין בו כדי לגרוע מזכויות הלקוח לפי דין.
7.1. תקופת הביטול: ניתן לבטל את העסקה ממועד ביצועה ועד 14 ימים מיום קבלת הפריט או מיום קבלת מסמך פרטי העסקה, לפי המאוחר.
7.2. הארכה לאוכלוסיות מסוימות: אדם עם מוגבלות, אזרח ותיק (בן 65 ומעלה) או עולה חדש רשאי לבטל תוך 4 חודשים ממועד העסקה, קבלת הפריט או קבלת מסמך פרטי העסקה, לפי המאוחר, ובלבד שההתקשרות כללה שיחה בין הצדדים (לרבות בטלפון, ב-WhatsApp, בצ'אט או בדוא"ל). העסק רשאי לבקש תעודה המעידה על הזכאות.
7.3. איך מבטלים: בכל אחת מהדרכים הבאות:

נא לציין שם מלא ומספר הזמנה.
7.4. דמי ביטול והחזר:
- 7.4.1. בוטלה העסקה שלא בשל פגם או אי-התאמה, יושב הסכום ששולם בניכוי דמי ביטול של 5% ממחיר הפריט או 100 ₪, לפי הנמוך מביניהם.
- 7.4.2. ההחזר יבוצע תוך 14 ימים מקבלת הודעת הביטול, באותו אמצעי תשלום.
- 7.4.3. בביטול שאינו בשל פגם, עלות המשלוח חזרה חלה על הלקוח ודמי המשלוח המקוריים אינם מוחזרים.
- 7.4.4. בוטלה העסקה בשל פגם, אי-התאמה לתיאור או אי-אספקה במועד, לא ייגבו דמי ביטול, יוחזר מלוא הסכום כולל דמי משלוח, והעסק יישא בעלות ההחזרה.
7.5. החזרת הפריט: יש להחזיר את הפריט לכתובת העסק, רצוי באריזתו המקורית ובמשלוח רשום ומבוטח.
7.6. חריגים: זכות הביטול לא תחול על פריט שיוצר, שונה או הותאם במיוחד עבור הלקוח (למשל חריטה או התאמת מידה). תכשיט משומש שלא שונה עבור הלקוח אינו בכלל החריג, וזכות הביטול חלה עליו במלואה.
7.7. ביטול על ידי העסק: העסק רשאי לבטל הזמנה אם הפריט אינו זמין, נפלה טעות בולטת במחיר או בתיאור, קיים חשד לשימוש לרעה, או שהתשלום לא אושר. במקרה כזה יוחזר ללקוח מלוא הסכום.
8. אחריות והתאמה
8.1. הפריט יסופק בהתאם לתיאורו בדף המוצר.
8.2. הפריטים משומשים ואינם מכוסים באחריות יצרן. סימני שימוש, שריטות או בלאי שתוארו בדף המוצר או נראו בתמונות הם חלק מתיאור הפריט ואינם פגם.
8.3. האחריות אינה חלה על נזק שנגרם לאחר המסירה משימוש בלתי סביר, מחשיפה למים, לבשמים או לכימיקלים, או מתיקון שביצע גורם אחר.
8.4. ככל שהדין מתיר, העסק לא יישא בנזקים עקיפים או תוצאתיים. אין באמור כדי להגביל אחריות שלא ניתן להגביל לפי דין או לגרוע מזכויות הלקוח לפי דין.
9. פרטיות
המידע הנמסר באתר נשמר ומעובד בהתאם למדיניות הפרטיות: https://houseofsymbols.co/pages/privacy-policy. דיוור שיווקי יישלח רק בהסכמה מפורשת, וניתן להסיר את עצמך ממנו בכל עת.
10. קניין רוחני
כל הזכויות בעיצוב האתר, בטקסטים, בלוגו ובצילומי המוצרים שייכות לעסק או ניתן לו רישיון לשימוש בהן. אין להעתיק או לעשות בהם שימוש מסחרי ללא אישור מראש ובכתב.
11. נגישות
פרטים על נגישות האתר ועל פנייה לרכזת הנגישות מופיעים בהצהרת הנגישות: https://houseofsymbols.co/pages/accessibility-statement.
12. לקוחות מחוץ לישראל
12.1. ללקוחות מחוץ לישראל חלות גם כל ההגנות הצרכניות המחייבות במדינת מגוריהם. אין בתקנון זה כדי לשלול אותן.
12.2. לקוחות באיחוד האירופי ובבריטניה רשאים לבטל את העסקה תוך 14 ימים מיום קבלת הפריט, ללא דמי ביטול וללא צורך בנימוק, כמפורט במדיניות ההחזרות.
13. שונות
13.1. על תקנון זה יחולו דיני מדינת ישראל, בכפוף להגנות הצרכניות המחייבות במדינת מגורי הלקוח.
13.2. סמכות השיפוט נתונה לבתי המשפט המוסמכים בתל אביב–יפו, מבלי לגרוע מזכות צרכן לפנות לערכאות במדינת מגוריו, ככל שהדין מקנה לו זכות זו.
13.3. סעיף בתקנון שייקבע כבטל לא יפגע בתוקף שאר הסעיפים.
13.4. התקנון מתפרסם בעברית ובאנגלית. ללקוחות בישראל, הנוסח העברי הוא המחייב. ללקוחות מחוץ לישראל, הנוסח האנגלי הוא המחייב.

1. General
1.1. The House of Symbols website at https://houseofsymbols.co (the "Site") is operated by Zohar Gur Arie, licensed dealer (Osek Murshe) no. 207021817 (the "Business", "we", "us").
1.2. These Terms apply to all use of the Site and all purchases made on it. By placing an order, you agree to these Terms.
1.3. We may update these Terms from time to time. Each order is governed by the version published on the Site when the order was placed.
1.4. Purchases may be made by persons aged 18 or over with an active email address and a valid means of payment.

3. Products
3.1. The Site sells pre-owned, second-hand and vintage jewelry. Any new items offered in the future will be identified as such on the product page.
3.2. The condition of each item, including signs of wear, scratches, imperfections or repairs, is described on the product page and documented in photographs. The photographs form part of the item's description.
3.3. Most items are one-of-a-kind. We do not undertake to restock an item or supply an identical piece.
3.4. Slight variations in color and shine between photographs and the item may occur due to lighting and screen settings. Measurements are approximate, within ±2 mm.
3.5. Metal descriptions are based on the hallmark on the item (for example, 925). Stones and inlays have not been laboratory-tested unless the product page states otherwise. We do not provide appraisal or gemological certificates.
3.6. Pendants are sold without a chain unless the product page states otherwise. Chains and accessories shown in photographs are not included.
3.7. Items are not affiliated with any commercial brand and are not sold as branded items.
4. Prices and Payment
4.1. Prices are stated in Israeli Shekels (ILS) and include VAT as required in Israel.
4.2. Prices shown in other currencies are approximate conversions for convenience only. Exchange rates and conversion fees are set by your card issuer or payment provider.
4.3. For orders shipped outside Israel, prices may be shown without Israeli VAT in accordance with applicable law. Where this applies, it will be shown at checkout.
4.4. Shipping costs, where applicable, are shown separately before you confirm your order.
4.5. Payment is made using the methods shown at checkout, through secure payment providers. We do not store card details.
4.6. We may change prices at any time. The price that applies is the one shown when you placed your order.
4.7. If an obvious clerical error occurs in a price or description, we may cancel the order and refund the full amount paid.
5. Orders and Confirmation
5.1. After you place an order, you will receive an email confirming that we have received it.
5.2. The order is confirmed subject to payment approval and item availability.
5.3. If payment is not approved or the item is unavailable, we will notify you within 3 business days and cancel the order at no charge. Any amount already charged will be refunded in full.
5.4. A document with the transaction details, including information on your right to cancel, will be sent by email or included with the shipment.
6. Delivery and Shipping
6.1. Within Israel: delivery within up to 14 business days from order confirmation.
6.2. International: delivery within up to 25 business days from order confirmation.
6.3. Business days are Sunday to Thursday, excluding holiday eves, public holidays and rest days in Israel.
6.4. For international orders, customs duties, import taxes, local VAT and clearance fees in the destination country are payable by the customer, unless stated otherwise at checkout.
6.5. You are responsible for providing a complete and accurate address. A shipment returned to us because of an incorrect address or non-collection may be re-sent subject to additional shipping charges, where permitted by law.
6.6. Risk in the item passes to you when the item is delivered to you or to a person you have designated.
6.7. Further details are set out in our Shipping Policy.
7. Cancellation, Returns and Refunds (Customers in Israel)
This section follows the Israeli Consumer Protection Law, 5741-1981, and the Consumer Protection Regulations (Cancellation of Transaction), 5771-2010. Nothing in it limits your rights under applicable law.
7.1. Cancellation period: You may cancel from the date of the transaction until 14 days after receiving the item or the transaction details document, whichever is later.
7.2. Extended period: A person with a disability, a senior citizen (65 or over) or a new immigrant may cancel within 4 months of the transaction, receipt of the item or receipt of the transaction details document, whichever is later, provided the transaction involved a conversation between the parties (including by phone, WhatsApp, chat or email). We may ask for documentation of eligibility.

Please include your full name and order number.
7.4. Cancellation fees and refunds:
- 7.4.1. If you cancel for a reason other than a defect or non-conformity, we will refund the amount paid less a cancellation fee of 5% of the item price or ILS 100, whichever is lower.
- 7.4.2. Refunds are made within 14 days of receiving the cancellation notice, to the original payment method.
- 7.4.3. If you cancel for a reason other than a defect, return shipping is at your expense and the original shipping cost is not refunded.
- 7.4.4. If you cancel because of a defect, non-conformity with the description, or failure to deliver on time, no cancellation fee applies, we will refund the full amount including shipping, and we will cover the cost of the return.
7.5. Returning the item: Please return the item to our business address, preferably in its original packaging and by tracked, insured post.
7.6. Exceptions: The right to cancel does not apply to items made, altered or customized specifically for you (for example, engraving or resizing). A pre-owned item that has not been altered for you is not covered by this exception, and the right to cancel applies to it in full.
7.7. Cancellation by us: We may cancel an order if the item is unavailable, there is an obvious error in price or description, misuse is suspected, or payment is not approved. In that case, you will receive a full refund.
8. Warranty and Conformity
8.1. The item will be supplied as described on the product page.
8.2. Items are pre-owned and not covered by a manufacturer's warranty. Signs of wear, scratches or use that were described on the product page or visible in the photographs form part of the item's description and are not defects.
8.3. This does not cover damage occurring after delivery from unreasonable use, exposure to water, perfume or chemicals, or repairs carried out by others.
8.4. To the extent permitted by law, we are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited by law or affects your statutory rights.
9. Privacy
Information you provide is handled in accordance with our Privacy Policy: https://houseofsymbols.co/pages/privacy-policy. Marketing messages are sent only with your explicit consent, and you may unsubscribe at any time.
10. Intellectual Property
All rights in the Site's design, text, logo and product photographs belong to us or are licensed to us. They may not be copied or used commercially without our prior written consent.
11. Accessibility

12. Customers Outside Israel
12.1. If you live outside Israel, you also benefit from any mandatory consumer protections of your country of residence. Nothing in these Terms removes them.
12.2. Customers in the European Union and the United Kingdom may withdraw from the contract within 14 days of receiving the item, without giving a reason and without a cancellation fee, as set out in our Returns & Refund Policy.
13. Miscellaneous
13.1. These Terms are governed by the laws of the State of Israel, subject to the mandatory consumer protections of your country of residence.
13.2. The competent courts of Tel Aviv–Jaffa have jurisdiction, without affecting any right you may have under applicable law to bring proceedings in your country of residence.
13.3. If any provision of these Terms is found invalid, the remaining provisions remain in effect.
13.4. These Terms are published in Hebrew and English. For customers in Israel, the Hebrew version prevails. For customers outside Israel, the English version prevails.
